Domestic helps to get maternity leave

The government on Monday approved a draft ensuring the rights of the domestic helps, incorporating a provision for them to enjoy a four months’ maternity leave with salary.
The latest move recognises the work of a domestic help as a profession under the existing labour laws and sets 14 years as the minimum for employment.
The seal of approval to the draft styled ‘Domestic Help Protection and Welfare Policy 2015’ was given during the weekly cabinet meeting at the secretariat with Prime Minister Sheikh Hasina in the chair.
After the meeting, Cabinet Secretary Shafiul Alam told the media that domestic helps will now enjoy various facilities with the approval of the draft.
“An individual with the minimum of 14 years old can be employed as domestic help and salary and working hours be settled through negotiations.”
Shafiul said household work would be recognised as profession due to the policy and domestic helps would get four-month maternal leave.
The draft has also a provision to allow them to have rest and relaxation.
About the use of torture by masters, the secretary said the government would take legal action under existing laws for torturing domestic helps.
The draft law has a provision to employ domestic helps with the minimum of 12 years old. If anybody wants to employ a domestic help aged 12, the appointer should conduct negotiations in the presence of a third party to this end.
It, however, bars an employer from forcing a sick aide to do household chores.
The draft also mentions that the master should bear treatment costs while the domestic help should be allowed to perform his/her own religion.
It has a provision of taking legal redress if a domestic help falls victim to physical or mental torture or sexual harassment.
If a domestic help files any case of sexual harassment or physical or mental torture, the government itself runs the case.
However, an employer may cancel the job of a domestic help and take action against the aide for misbehaviour with children, senior citizens or others.
The law mentions that the master will file a general diary with a local police station if an aide leaves the house without informing anyone.
A master can go for legal recourse if an aide leaves home stealing valuables.
In normal process, the master should serve a one-month notice on the worker to cancel the job. The same rule will also apply for the worker.
The master should have to pay one month’s salary to the worker in case of cancelling a job instantaneously.
A cell under labour ministry will work to implement the policy.
The cabinet also approved the draft of the president’s speech to be delivered in the first session of parliament next year.
Drafts for the laws of Bangladesh Investment Authority and Bangladesh Small and Cottage Industries Corporation also got the cabinet’s nod.
